On January 25, 2026, two NIH researchers, Vincent Munster and Claude Kwe, were stopped at Detroit Metropolitan Airport after returning from the Republic of Congo. A large black plastic case containing 113 vials in Styrofoam coolers was found in their luggage.
Seventeen of the tested vials contained monkeypox virus. The virus was deactivated, meaning it was treated or rendered unable to infect anyone. The researchers allegedly told customs officials the case contained diagnostics and testing equipment.
On June 2, 2026, the Department of Justice charged them both with conspiracy to smuggle biological materials into the United States and making false statements to federal officials. Both plead not guilty.
The DOJ press release referred to them as "foreign nationals." The same prosecutor has brought similar cases before, and all involved non-American scientists. Several virologists have declined to comment on the record.
The Society has questions.
Who are Drs. Munster and Kwe?
Dr. Munster received his PhD in virology from Erasmus University Rotterdam in the Netherlands in 2006. He is is the Chief of the Virus Ecology Unit in the Laboratory of Virology at Rocky Mountain Laboratories in Hamilton, Montana.
His research encompasses a broad range of topics related to viral infections and pandemics, including COVID-19, Ebola, MERS, and influenza.
Dr. Kwe is a postdoctoral researcher at the NIH/NIAID’s Rocky Mountains Laboratory, Hamilton, Montana. He received his Bachelor's and Master's in Biochemistry from the University of Buea in Cameroon. He later earned his PhD from the University of Leuven (KU Leuven) in Belgium, where he studied viral metagenomics.
His research involves uncovering and describing novel and emerging viruses, their potential to cause human disease, and the factors that determine cross-species viral transmission.
What is the Rocky Mountain Laboratory?
Rocky Mountain Laboratories (RML) is part of the NIH research program, and it is located in Hamilton, Montana. It is operated by the National Institute of Allergy and Infectious Diseases. One of the few level 4 biosafety laboratories in the United States is housed there. l 3 and ABSL3/4 laboratories.
RML's origins date back to 1902 when public health officials began makeshift, tent-based investigations into a deadly, unidentified disease plaguing settlers in the Bitterroot Valley. This was eventually identified as Rocky Mountain spotted fever. The permanent facility was constructed in 1928, and it has evolved into a vital biocontainment resource for federal health and biodefense research.
What are the rules for transporting biological materials?
If the inactivated sample poses a risk to humans (such as human pathogens, bodily fluids, or non-human primate products), the CDC is responsible for oversight through the CDC Import Permit Program.
The key point is that materials rendered completely non-infectious generally do not require a standard CDC Import Permit. However, you are required to provide a certification that includes a detailed description of the material and how/when it was rendered non-infectious.
If the sample is of animal or plant origin, or could pose a threat to U.S. agriculture and livestock, the USDA, through the Animal and Plant Health Inspection Service, is responsible. An import permit may be required, and some specific items require prior approval or import, even if they are inactivated.
All biological materials, including non-infectious samples, must be fully documented, declared, and presented to U.S. Customs and Border Protection (CBP) upon entry.
Apply the PICO Framework
The question matters as much as the answer.
Before forming an opinion on this case, the Society suggests applying the same framework we use to evaluate any health claim.
Ask: What is the actual question being answered here?
The DOJ's question is: Did these researchers violate customs regulations and lie to federal officials?
The scientific community's question is: Did these researchers pose a meaningful public health threat?
These are not the same question. They produce different answers. And conflating them is how bad health policy gets made.
The DOJ's evidence is straightforward. The researchers carried undeclared biological materials through a commercial airport and denied it when asked about it. That is a customs violation. The law does not require the materials to be dangerous; rather, it requires them to be declared.
The scientific community's counter is also straightforward. Deactivated virus samples are, by definition, unable to infect anyone. Researchers routinely bring samples across borders for diagnostic purposes. The regulatory process for doing so properly is burdensome and inconsistently enforced. These samples were being transported to a BSL-4 facility, one of the most secure laboratories in the world.
Both of these things can be true simultaneously.
The Professional Disagreement
When experts disagree, the question is always: disagree about what, exactly?
The disagreement here is not about the facts. Both sides agree on what happened. The disagreement is about what the facts mean and who gets to decide.
Law enforcement sees a biosecurity violation with potential public health implications. The scientific community sees a regulatory failure being prosecuted as a criminal conspiracy. The political context includes foreign nationals, a current administration that has repeatedly targeted non-American researchers, and a prosecutor with a pattern, which is either entirely relevant or entirely irrelevant, depending on which framework you apply.
The Society does not take a position on the guilt or innocence of Dr. Munster or Mr. Kwe. That is for the courts. What the Society does note:
The framing of the DOJ press release is doing significant work. "Foreign nationals." "Smuggling viral pathogens on a packed commercial airplane." "Let that sink in." These are the words of a press release designed to produce a specific public reaction. They are accurate. They are also selective.
The virologists who will not speak on the record are also doing significant work. When experts in a field decline to publicly defend what they appear to privately believe is a defensible practice, the Society asks why. Fear of political consequences is a reasonable answer. It is also worth noting.
The silence is data.
The Upstream Question
What does this mean for the next outbreak?
The Republic of Congo has experienced an mpox outbreak linked to more than 2,000 deaths. Researchers were there studying it. They came back with samples that, properly handled, could contribute to understanding and eventually controlling it.
The regulatory system for bringing those samples back legally exists for good reasons. It also creates friction that researchers routinely navigate imperfectly. The question the Society is watching is not whether these two researchers broke the law. It is whether the law, as currently written and enforced, serves the public health interest it was designed to protect.
If the answer is that prosecuting researchers for bringing deactivated samples through customs deters future research into active outbreaks, the Society thinks that is a meaningful public health cost worth naming. Even if the prosecution is technically correct.
Upstream thinking means asking not just whether the rules were followed, but whether the rules are producing the outcomes they were designed to produce.
